KAM BALDAI PURCHASE AND SALE TERMS AND CONDITIONS

1. GENERAL PROVISIONS

1.1. These purchase and sale terms and conditions (hereinafter – the Terms) establish the rights, duties, and responsibilities of the buyer and the seller when the buyer purchases goods in the KAM BALDAI online store, accessible at www.kambaldai.lt .

1.2. Seller:

  • Company name: MB Printvelas
  • Company code: 307164471
  • VAT payer code: LT100020807010
  • Registered address: Tilto g. 5, Tauragė, LT72315
  • E-mail: info@kambaldai.lt
  • Phone: +37063042851
  • Website: www.kambaldai.lt

1.3. By placing an order in the online store, the Buyer confirms that they have read these Terms and agree to comply with them.

1.4. The Terms apply to all purchases made in the online store, except in cases where mandatory provisions of the legal acts of the Republic of Lithuania stipulate otherwise.

1.5. If the Buyer is a consumer, they enjoy all consumer rights provided for in the legal acts of the Republic of Lithuania and the European Union. These Terms cannot limit or eliminate mandatory consumer rights.

2. ORDERING GOODS AND CONCLUSION OF CONTRACT

2.1. The Buyer may purchase goods in the online store by filling out the order form and selecting the offered payment and delivery method.

2.2. A purchase and sale contract is considered concluded when the Buyer places an order and the Seller confirms its acceptance by e-mail or begins executing the order.

2.3. The Buyer must provide accurate and complete data necessary for the execution of the order and the delivery of the goods.

2.4. The Seller has the right to contact the Buyer if it is necessary to clarify the order, delivery, or other information related to the purchase.

2.5. If, after placing an order, it turns out that the supplier of the goods can no longer deliver them, the Seller shall inform the Buyer and offer possible solutions: to choose another product, to wait for a restock, or to cancel the order and receive a refund.

2.6. Photographs of goods in the online store are for illustrative purposes. The Seller strives to ensure that the provided information is as accurate as possible, but certain visual differences may arise due to screen settings, lighting, shooting conditions, or the characteristics of natural materials.

3. PRODUCT PRICES AND PAYMENT PROCEDURE

3.1. All prices indicated in the online store are in euros (€), including applicable taxes, unless otherwise specified.

3.2. The price of the goods is as indicated at the time of placing the order. The delivery fee is indicated separately or included in the price of the goods, depending on the delivery terms of a specific product.

3.3. The Buyer can pay for the goods using the payment methods offered in the online store.

3.4. KAM BALDAI applies the principle of prepayment. The order begins to be processed only after receipt of full payment for the product and, if applicable, the delivery service.

3.5. Until payment is received, the Seller is not obligated to order the goods from the supplier, reserve them, send them for production, or begin other actions related to the execution of the order.

3.6. Placing an order in the online store does not in itself mean that the product has already been ordered from the supplier or that production has started. The order is passed for execution only after the Buyer's payment is received.

3.7. If the Buyer does not pay for the order within the period specified by the Seller, the Seller has the right to cancel the order after informing the Buyer.

3.8. The Buyer is provided with a document confirming the purchase in accordance with the procedure established by legal acts.

4. DELIVERY OF GOODS

4.1. Goods are delivered to the address specified by the Buyer at the time of the order within the territory of the Republic of Lithuania or by another method indicated in the online store.

4.2. KAM BALDAI cooperates with furniture and interior goods suppliers, therefore some goods may be shipped directly from the supplier's warehouse to the Buyer.

4.3. The delivery term for goods is indicated in the description of the specific product or upon order confirmation. The indicated term is preliminary unless clearly stated otherwise.

4.4. If delivery is delayed due to circumstances beyond the Seller's control, the Seller shall inform the Buyer and indicate the updated estimated delivery term.

4.5. The Buyer must ensure that conditions for receiving the product at the delivery address are met, including the ability for the delivery transport to approach.

4.6. Delivery of goods to the building door, carrying into premises, carrying to the floor, and furniture assembly are included only if such a service is clearly indicated in the product description or order confirmation.

4.7. If the product cannot be delivered due to incorrect data provided by the Buyer or the Buyer's actions, the costs of re-delivery may be coordinated with the Buyer, in accordance with the requirements of legal acts.

4.8. Upon accepting the product, the Buyer should check the condition of the packaging. If obvious damage to the packaging or the product is noticed, the Buyer should document it with photos and, if possible, note it in the delivery documents.

4.9. Documenting damage to the packaging or product during delivery helps to investigate a claim faster, but does not invalidate the Buyer's statutory rights if the damage was discovered later.

5. INSPECTION, ASSEMBLY, AND DOCUMENTING DAMAGE

5.1. Upon receiving the product, the Buyer should inspect it and check the contents before starting assembly or use.

5.2. Upon noticing damage occurred during transport, missing parts, or other obvious discrepancies, the Buyer should inform the Seller as soon as possible, preferably within 5 calendar days of receiving the product, via e-mail at [insert e-mail], attaching photos and the order number.

5.3. If a product defect is noticed during assembly, the Buyer should stop assembly to avoid potential additional damage and contact the Seller.

5.4. The Seller requests that the Buyer inform about defects noticed during assembly within 5 calendar days of receiving the product. This period is intended for the prompt resolution of the problem and does not limit the Buyer's statutory rights regarding hidden defects or defects that could not have been reasonably noticed during inspection or assembly.

5.5. The Buyer should not independently repair the product or take actions that could complicate the identification of the defect until a further solution is agreed upon with the Seller.

5.6. After receiving information about a potential product defect, the Seller evaluates the submitted data and informs the Buyer about further actions.

6. COLORS, MATERIALS, AND NATURAL VARIATIONS

6.1. Product colors and shades may differ slightly from the image seen on the screen due to individual monitor, phone, or other device settings, lighting, and shooting conditions.

6.2. The pattern, shade, and texture of natural wood, stone, veneer, fabrics, and other natural or textured materials may differ from the provided photos. Such differences, when the product matches the described materials, color choice, and essential properties, are not in themselves considered a product defect.

6.3. Before placing an order, the Buyer should evaluate the product description, dimensions, materials, color, and other indicated properties.

6.4. The visual differences indicated in this section do not waive the Seller's liability if the delivered product does not essentially match the order, product description, or specifications confirmed by the Buyer.

7. INDIVIDUAL ORDERS AND RETURN OF GOODS

7.1. KAM BALDAI products can be ordered from suppliers after receiving the Buyer's order. However, such a method of ordering does not in itself mean that the product is considered manufactured according to the Buyer's individual instructions.

7.2. Individually manufactured or personalized goods are considered to be those goods that are produced according to specific instructions of the Buyer or clearly adapted to their personal needs, for example, according to individually chosen dimensions, non-standard configuration, special materials, or other individual production parameters, where the exception provided for in legal acts applies.

7.3. If the product falls under the exception provided for in Article 6.228¹⁰ of the Civil Code of the Republic of Lithuania regarding goods manufactured according to individual consumer instructions or clearly personalized, the Buyer does not have the right to withdraw from the contract simply because they have changed their mind, the product no longer suits their needs, or their wishes have changed.

7.4. This exception does not apply to the Buyer's rights related to a defective, damaged, or non-conforming product.

7.5. If the purchased product is not individually manufactured or personalized and is not subject to another statutory exception, the consumer has the right to withdraw from a remote purchase and sale contract within 14 days of receiving the product without giving any reason.

7.6. To exercise the right of withdrawal, the Buyer must provide the Seller with a clear notice via e-mail at [insert e-mail] or by another method indicated in the online store.

7.7. A high-quality returned product must be preserved in such a way that its nature, properties, and functioning can be determined. The Buyer may inspect the product to the extent necessary to determine its properties and functioning, but may be held liable for any decrease in the value of the product resulting from actions that were not necessary for such verification, as provided for by law.

7.8. In cases where the consumer has the right to withdraw from the contract, the product must be sent or handed over to the Seller no later than 14 days after submitting the notice of withdrawal, unless otherwise agreed by the parties.

7.9. Direct costs of returning the product shall be borne by the Buyer, unless the Seller agrees to cover them or legal acts provide otherwise. If the product is returned due to a defect or the Seller's liability, the costs of its return shall be resolved in accordance with legal requirements.

7.10. The Seller shall refund the amounts paid by the Buyer within the terms and in the manner established by law. The Seller may withhold the refund until the returned product is received or until the Buyer provides proof that the product has been sent, unless otherwise provided by law.

7.11. The Buyer's request to return a high-quality product to which the right of withdrawal does not apply may only be satisfied with the Seller's goodwill agreement.

8. DEFECTIVE GOODS AND WARRANTY

8.1. The Seller is responsible for ensuring that the goods sold meet the requirements of legal acts, the product description, and the conditions of the Buyer's order.

8.2. If the product is defective, damaged, incomplete, or does not match the order, the Buyer has the right to submit a claim to the Seller.

8.3. Depending on the specific situation and legal requirements, the Buyer may request:

  • to eliminate product defects;
  • to replace a defective product with a non-defective one;
  • to proportionately reduce the price of the product;
  • to terminate the contract and receive a refund when there is a statutory basis for doing so.

8.4. The Seller evaluates the Buyer's request and provides an answer in accordance with the procedure established by law.

8.5. Consumer rights regarding product quality are valid within the terms established by law. These Terms cannot shorten the terms established by law or limit consumer rights.

8.6. The Seller is not liable for defects caused by improper assembly, use, maintenance, or mechanical damage, if it is determined that the defect was caused by the Buyer's actions rather than a manufacturing defect or other non-conformity.

8.7. If an additional commercial warranty is provided for the product, its conditions are provided together with the product or in the product description. The commercial warranty does not cancel or limit statutory consumer rights.

9. SUBMISSION AND HANDLING OF CLAIMS

9.1. The Buyer can submit claims regarding product quality, configuration, delivery, or other order-related issues via e-mail at [insert e-mail].

9.2. It is recommended to include the following in the claim:

  • Buyer's name and surname;
  • order number;
  • product name;
  • description of the problem;
  • desired solution;
  • photos or other supporting documents of the problem, if available.

9.3. The Seller examines the consumer's request and provides a motivated response within the deadlines established by law.

9.4. If the Buyer is not satisfied with the Seller's response or if the dispute cannot be resolved by agreement, the Buyer has the right to contact the State Consumer Rights Protection Authority or another competent institution in accordance with the law.

10. LIABILITY OF THE BUYER AND THE SELLER

10.1. The Buyer is responsible for the accuracy of the provided personal and delivery data.

10.2. The Seller is responsible for the fulfillment of its obligations under these Terms and applicable legal acts.

10.3. Neither party is liable for the non-fulfillment of obligations if it was caused by force majeure circumstances, as defined by the legal acts of the Republic of Lithuania.

10.4. The Seller is not liable for the actions of a supplier or transport service provider to the extent that liability falls upon another person under the law, but this does not waive the Seller's duties to the Buyer under the concluded purchase and sale contract.

11. PROCESSING OF PERSONAL DATA

11.1. The Buyer's personal data is processed for the purpose of accepting and fulfilling the order, organizing delivery, fulfilling accounting obligations, handling claims, and pursuing other legitimate interests.

11.2. Personal data is processed in accordance with applicable personal data protection laws and the Seller's Privacy Policy.

11.3. Detailed information about personal data processing is provided in a separate document – the Privacy Policy, published in the online store.

12. FINAL PROVISIONS

12.1. These Terms are drawn up in accordance with the legal acts of the Republic of Lithuania.

12.2. The Seller has the right to change the Terms, but changes do not apply to already concluded transactions, except where legal acts or the parties agree otherwise.

12.3. Changes to the Terms take effect from the day of their publication in the online store, unless otherwise specified.

12.4. All disputes are primarily settled through negotiations. If an agreement cannot be reached, disputes are settled in accordance with the procedure established by the laws of the Republic of Lithuania.

12.5. If any provision of these Terms is held to be invalid, this shall not affect the validity of the other provisions of these Terms.
